Two rules matter more than almost anything else in a Tennessee injury case.
Tennessee generally limits non-economic damages (pain and suffering, loss of enjoyment of life) to $750,000, raised to $1,000,000 for injuries the statute defines as catastrophic. The cap is removed entirely only in narrow circumstances — for example where the defendant intentionally falsified, destroyed or concealed evidence, acted with specific intent to injure, was under the influence of alcohol or drugs, or was convicted of a felony arising from the same act. Economic losses such as medical bills and lost wages are not subject to the cap. How the cap applies to a specific case is a question for a licensed Tennessee attorney.
